1. Scope

(1) These General Terms and Conditions (AGB) apply to all orders from consumers (§ 1

KSchG), which are concluded through the online shop JL-Living.

(2) Consumers in the sense of these GTC are natural persons who conclude a legal transaction for purposes that

cannot be predominantly attributed to their commercial or independent professional activity.

(3) The goods are only offered in household quantities.

3. Conclusion of contract

(1) The product representations in the online shop do not constitute a legally binding offer, but rather a

4. Offer, product representations, availability

5. Prices and Shipping Costs

(3) Customs/duties for deliveries outside the EU as well as any bank fees are borne by the customer.

6. Payment Terms

(1) Payment is made via the payment methods specified in the shop (e.g., PayPal, credit card, Apple Pay). We

(2) The purchase price is due immediately.

(3) The goods remain the property of the seller until full payment is made (retention of title).

7. Delivery

(1) The delivery takes place within 14 days after the conclusion of the contract, unless otherwise stated in the offer

(2) The delivery is made to the delivery address specified by the customer.

(3) For consumers, the risk of accidental loss or accidental deterioration of the goods only

upon delivery of the goods to the customer.

(4) Transport damages: Please report any obvious transport damages as soon as possible to the deliverer and

please contact us immediately. A failure to raise this complaint has no effect on statutory

Claims, however, facilitate our enforcement against the carrier.

(5) Partial deliveries are permitted as long as they are reasonable for the customer. Additional shipping costs arise from this

8. Right of withdrawal

(1) Consumers have a right of withdrawal in accordance with the provisions of the Distance and Foreign Trade Act

(FAGG).

(2) The withdrawal period is 14 days from the day the customer has taken possession of the goods.

(3) To exercise the right of withdrawal, the customer must inform the seller by means of a clear declaration (e.g. email) about

11. Liability

(1) The seller is fully liable for intent and gross negligence.

(2) In cases of slight negligence, the seller is only liable for damages resulting from the violation of life, body, or

for health as well as for damages resulting from the violation of essential contractual obligations.

13. Change of the GTC

JL-Living reserves the right to change these GTC at any time. For orders, the version in effect at the time of the order applies.

14. Final provisions

(1) Only Austrian law applies, excluding the UN Sales Convention.

(2) For consumers residing in the EU, the statutory jurisdiction of their residence applies.

(3) Should individual provisions of these GTC be ineffective, the effectiveness of the remaining provisions remains unaffected.

(4) The prices listed in the online shop of JL LIVING are created with the utmost care. Nevertheless, there may be technical errors or input mistakes in individual cases.

If a price indicated in the online shop is obviously incorrect and the actual price deviates significantly from it, JL LIVING reserves the right to contest the purchase contract due to error in accordance with § 871 ABGB (or § 119 BGB in Germany).

In such a case, the customer will be informed immediately, any payments made will be fully refunded, and there will be no obligation to deliver the goods at the incorrect price.

Price indications are therefore non-binding and subject to change until a explicit order confirmation is issued by JL LIVING.
